Charles “Charley” Barr is a Bates Consulting and Testifying Expert, a practicing corporate attorney for 46 years for property-casualty and life & annuity insurers and reinsurers, brokers and two derivative dealers. He has also been a General Counsel and C-Suite executive for 25 years—time that included four public companies, a claim department manager, a casualty underwriter, and a CPCU. Charley has been an arbitrator and umpire since 2000, including disputes surrounding expert testimony. He is certified by AAA, FINRA, and ARIAS.
Charley is a holding company structure and transaction specialist who achieves results by assembling the expertise of legal and regulatory practice as well as financial condition management. He also is skilled at bringing together actuarial and corporate reserving talent within domestic, offshore and international insurance and reinsurance groups, including those practicing offshore tax mitigation.
He is a student of insurance and reinsurance contracts and coverage for property-casualty and life & annuities as well as variable contracts issued domestically and offshore. He established and led tax and compliance structuring of a global derivatives firm. Charley currently advises a prominent global reinsurance broker whose investment bank is the largest global structurer, bookrunner, and placement agent for Insurance Linked Securities (ILS).
Charley has conducted several change-in-control (Form A), redomestication and prior-approval hearings before departments of insurance (DOI) and has represented employers and staff before the Securities and Exchange Commission, the Department of Justice, state Attorneys General, and DOIs regarding compliance and regulated activity. He has managed legal, compliance, and regulated rate and form departments at global (re)insurers comprised of more than 50 attorneys, paralegals, and insurance law compliance professionals. He has formed, licensed, capitalized, acquired, and sold insurers and agencies domestically and internationally. Charley has redomesticated insurers, revised holding company ownership (stacking), crafted disciplined dividend payment programs to increase net income and enhance the ultimate parent’s dividend paying capacity and crafted inter-company reinsurance pooling agreements for more efficient reinsurance purchasing and expense and loss payment management.
Previous expert assignments involved Utmost Good Faith in reinsurance, duties of p/c and life program managers, facultative reinsurance coverage issues, payment of persistency life insurance commissions on run-off business, surplus lines insurance placements and non-renewals, and coverage questions regarding Employers’ Liability under Workers’ Compensation policies.
